15.209 clearly says EXCEPT AS PROVIDED ELSEWHERE IN THIS SUBSECTION...
Indeed there are other allowances provided elsewhere including 15.217 (160-190kHz); 15.219 (510-1705kHz) the almost Biblical and well quoted section; and 15.221 (AM Carrier Current); on up the list.
It doesn't happen a lot, but this time I am right and I'm not giving it up.
I think interpretations can go in any direction when faced with a conundrum.
The statement of except as provided elsewhere clearly is saying there are other sub parts to account for. So with that alone, it clearly means anything else BUT the fundamental. NO where within 209 ANYWHERE does it state 209 is the regulating rule for the fundamental. As I quoted direct from the ECFR site, and other parts within 209, it says emissions going above the fundamental. It does not even say 209 is for the fundamental in your own quote. Regardless, and I say it again, there cannot be two sets of regulations for the same thing and those two regulations are completely different.
I think it is you who needs to read it again. In the meantime, I stick to what I know and what the FCC field agent tells me what is what. 😛

there is no carrier current provision alternative under any other rule part for 15.217 so in order to do carrier current it needs to be done under 15.209.
The manual indicates this model was available on 3 frequencies: "A" = 200 kHz, "B" = 160 kHz, "C" = 230 kHz.
They offered the item as catalog number 43-212(x). The "x" denotes model A, B or C which identifies the frequency of the unit. I have the "B" model, 43-212B.
If anyone is interested the manual includes a schematic.
The method used for coupling the RF to the AC line is substantially similar to the CC tube transmitter that I posted some time ago.

Not trying to turn against you or anyone. Just saying what I was told it would mean that 209 refers to out of band emissions when operating CC...I mean that is the discussion isn't it..CC of the LW frequencies?
