There was a temp announcer at this TV station who shared a common desk with other announcers. One day he said to me, "There's a lapel mic in the middle drawer. If it's still there in a month I'll consider it abandoned and take it with me."
His special ethics occur to me now as I notice 87.7 MHz, a publicly owned FM channel abandoned (in some areas) by the FCC. I am thinking, "If it's still unused in a month I'll take it."
Warped ethics might be a symptom of low vitamin D levels brought on by limited winter sunlight.

No matter the "ethics" or justifications of unlicensed operators, the FCC does not permit them to transmit on frequencies that are not authorized for unlicensed use under FCC Part 15 -- even if those frequencies are otherwise vacant in a given geographic area.
The use of either 87.7 MHz or 87.9 MHz is not authorized by FCC Part 15 for the unlicensed use of FM transmit systems -- even if those frequencies are locally vacant, otherwise.
