In a previous thread titled Does the FCC Consider Part 15 Operators Broadcasters the matter of "Part 15 Station Identification" was brought under discussion.
An FCC Rule on the subject is found in Section 73 of the Rules:
73.3550 Requests for new or modified call sign assignments (1) Users of nonlicensed, low-power devices operating under part 15 of this chapter may use whatever identification is currently desired, so long as propriety is observed and no confusion results with a station for which the FCC issues a license.
Testimony submitted from a "scientifically accurate" claimant held that three or four letter call-signs beginning with either K or W could result in confusion with licensed stations and thus violate this rule.
The matter was appealed to the Transcendental Court and overturned, to wit:
K or W call-signs, even if they match an extant licensed radio station, do not violate 73.3550, except when or unless the overall identification used by the unlicensed station perfectly matches that of a licensed station in all aspects, e.g., same call letters, same slogan, same city of license.
The Highest Court further clarified the matter a non-scientific one, but rather one of definitional specificity.
As was noted in the decision, part 15 radio broadcasting stations have an established pattern of employing three and four letter K or W call signs and no violation has every resulted in the case history of the FCC.
WDCX
Oh geeze all the ones I have used...
WPIA, WMTX, KEWS, KTRX, KDWP, KQRO, KDSX, KDSQ, KIKM...
I used KEWS and KQRO the longest.
This is what I spoke about on the team speak server for the ALPB meeting of Saturday March 5 2016.
You can have two stations in the USA using the calls WABC and WABC-LP, both are different calls altogether and are often located in totally different market areas, or a different part of the country.
Bruce.
Thanks Carl now I feel better about using WAQM which stands for Album rock for the quarter mile. And of course my slogan is break free from the shackles of top 40 and rap. Looking at the FCC database there is no WAQM. So that means I'm able to use that.
The majority has it.
i have always used one call sign and that was KDSX paying a homage and tribute to the orginial KDSX here in my hometown...
however mighty i am surprised that you used KDSX as one of your call signs on one of your radio stations even though i had the call letters and the branding copyrighted since 2012...
but i digress, doesnt really matter anymore
When I saw you had signed off your KDSX I figured I'd keep them alive in the area. If you ever decide to start broadcasting again let me know and we can work something out 🙂
Though in hindsight given my current format the KIKM calls would've made more sense. KDSX was largely a news station, KIKM was the top 40. (Not to mention the KIKM gear I managed to get)
"The majority has it."
____________
If the majority of Part 15 users "has it" as far as defining/understanding FCC Rules, then what accounts for all the NOUOs that the FCC has issued to operators of unlicensed "Part 15" systems that were determined by the FCC to be non-compliant with Part 15 ?
Are we talkin' 'bout NOUO's for improper call signs?
Good member Rich I took your predictable dissenting vote into account, but the PARTICIPANTS OF THIS THREAD outvoted you.
Also, I knew you'd take the discussion afield away from what it's actually about as just noticed by MRAM 1500.
Carry on.
No, we're talkin' 'bout FCC Rules as being the result of a majority vote of those subject to their use.
Thanks, thought I stumbled into another thead.
Rather than highjack this thread by double-shifting away from what actually took place in this one to an entirely counterfeit notion that rule users in general vote on rules, a novel but ludicrous idea, simply start a new thread to discuss your fanciful claims.
My guidance counselor told me I should ignore your taunts, which is going into effect now... 3...2...1...0... Ignore Invoked.
... that rule users in general vote on rules, a novel but ludicrous idea ...

Then why was this notion first introduced by the author of the above clip, where, in Reply 6 he posted "The majority has it ?"
