Classical Music Programming on Artisan Radio

I've posted here previously about my intention to confine Artisan Radio programming to all public domain material (in Canada).  No licensing fees, no musical reproduction fees (for archived broadcasts), no record keeping - there are numerous reasons why I've decided to go this particular route.

In the U.S., there are NO recordings in the public domain (until sometime in the mid 2030's) and only songs written prior to 1922.  Canada's copyright laws were much less draconian (at least until recently - they were amended in 2015 for recordings, and 2016 for songs) and there is a large body of music that is still in the public domain (the amendments didn't change the status of all material that had fallen into the public domain before they were signed into law).

So, I've commenced my gathering of public domain classical music (anything recorded in 1964 & earlier, whose creator(s) passed away prior to 1965).  While I'm nowhere near completed, you can tune into the station and get a sampling.  A lot of these recordings are amongst the best ever recorded for their particular work - better technology in sound recording doesn't necessarily mean better performances.  There are no vocal ID's yet - I'm still thinking about how I want to do them.  The song metadata (if your player displays it) contains the composer & name of the work, but no details on the performers - that will be found in the soon-to-be-included ID's).

This is a downloadable file right? I assumed so from the mp3 extension.. but now I'm wondering and don't want it to keep downloading forever..

You can certainly braodcast PD classical music over the air with no music rights issues, as the songs themselves are PD, and in the USA radio only pays song WRITERS, and never performers.  And those songs will be PD, assuming you're not including "modern" calssical music newer than 1922. 

The trouble starts if you stream, as then you must pay for the performance (recording) e.g. the New York Philharmonic gets a royalty. 

But this is not the case if you're just over the air.

Rich, it's a stream. Winamp & other similar players are fine with it.

Tim, what you describe is true for the U.S. What I describe is true for Canada.
