To set up strengthy transmitter/linear operations to speak over the air has got to be motivated by the need to say something in the hope that someone is tuned in.

The article refers twice to an "unlicensed transmitter". Transmitters are not licensed for the ham bands, operators are. The folks at ARRL know that (or should).
With the relative ease of obtaining a ham license, especially if you already had one, it is surprising that the operator didn't renew or upgrade.
I wonder what kind of "interference" he was creating to prompt a complaint. It is hard to imagine that ham operators check the validity of the licenses of other hams on a routine basis but anything is possible I suppose.

OMG! Hams narc on each other all the time. I knew a blind ham that was cited for operating 5KC's out of the novice band when he was talking to someone in CW. They are the first to narc on a part 15 FM station if they are 251 Uv/M instead of 250. Trust and believe from experience they do play Radio police and scan AM and FM for distant and pirate Radio.
Neil if you look at the NAL it is the FCC who used the phrase "unlicensed radio transmitter."

You are correct that this phrase was used in the NAL but reading further they cite:
"1 47 U.S.C. § 301.
2 Part 15 of the Rules sets out the conditions and technical requirements under which certain radio transmission devices may be used without a license. In relevant part, Section 15.209 of the Rules provides that non-licensed operation in the 1.705-30 MHz band is permitted only if the field strength of the transmission does not exceed 30 μV/m at thirty meters. 47 C.F.R. § 15.209."
which references the use of "certain devices". A picky point which doesn't change the outcome.
