Since we're both in Canada I need to know if it would be illegal or legal to broadcast on 87.7 or 87.9 on FM. If all the space ever got used up over the rest of the band could that be an alternative? TV channel 6 audio used to be on 87.7 but they have long since vacated and most radios will tune from 87.7 to 108. No stations are there and no chance of interference with or from anything else. Of course the same BETS-1 would apply. Just wondering?

It's not legal to broadcast on those channels.  Basically, the technical specs for RSS-210 apply to all BETS transmitters (RSS-210 is virtually identical to FCC Part 15.219, with the proviso that BETS allows greater field strength).  It would be nice, though.
