I am looking into buying this kit but before i do i was wondering if it would fall under part 15 or if there is a chance that i would get busted by the fcc

A 15 Watt FM transmitter you intend to use license free under Part 15.239 rules would be most likely not compliant and put you at risk from the FCC.
The rules limit the field strength at a distance and this limit can be produced by a transmitter running very much less power than 15 Watts.

Only if it's power adjustable so you can turn the power WAY down. 15 watts can cover a lot of territory...a good section of a small city in the right location with the right antenna.
Is this a kit you put together yourself or a ready to use Chinese one?
Yeah, you can get busted, and you'll be interfering with radio's and CRT TV's around you if you go full power.
Also if a station manager of a commercial station in your area picks this up he or she might report it and the FCC may then investigate.
