The FCC of recent years has been bombarded by radio amateurs and others regarding contractual covenants and restrictions. The FCC has had plenty of opportunity to address all the concerns. The feds have chosen, for statutorial reasons, the remain on the fence and rule neither for radio operators or for HOA’s. The official stance has been to allow Congress to wrestle with news laws concerning the issues involved with CC&R’s.
HOA’s are historically run by a small group of homeowners who are chosen by the neighborhood to ensure the security and integrity of the neighborhood. Having lived in Las Vegas with 2 million population and 95 percent of new homes in HOA’s, it seems somewhat simplistic to say HOA’s preserve the value of homes in those neighborhoods when 1 out of 30 homes in Clark County are in foreclosure and most homes have lost nearly ten percent in value in the last year because people have simply defaulted on the loans. Now, how do you suggest HOA’s control that sort of bedlam?
I have never fully agreed with “mob rule”. And coming from Vegas, I understand mob rule.
