Yeah, I think this may go beyond a simple pirate install. There are probably local politics involved. I mean, how long was it before Free Radio Santa Cruz got raided? And how much actual grief did they give the fcc before the fed said "We're comin ta getcha.." ? So.. for this to be a first offense and get a raid? Also - jail time? You don't typically go to jail in US for a pirate station.. usually get the threat of a fine.. and even then, you have to be a pretty big weenie to get forcibly shutdown and tossed in jail...
Ah - this is speculation, since I didn't bother to read up the public documents regarding this with the NYPD..
