I was shocked and dismayed to say the least that when I was looking around Part15.us this evening that you have started up the Daddy G’s Oldies Show again.
Several years ago, you have sold the masters and all rights to the show to Bry Hadley. A couple of months later, I was offered the ownership to these masters and the rights to the show. I purchased this show from Bry and have since taken ownership and the full rights to the show including the copyrights and trademarks to the Daddy G’s Oldies Show.
As the owner and copyright and trademark holder to the Daddy G’s Oldies Show, I must ask you to cease producing this show. You have no rights in starting this show again without the express written permission of WinniRadio, LLC and myself. Thus, you are now in violation of my copyrights and trademarks on this program that was sold to me.
Gerald, had you written to me to get my permission prior to resuming your show, you would have had my permission to do so with the following two stipulations. The first stipulation is that you would had to add an line at the end of the program stating that of: “Daddy G’s Oldies Show is copyrighted and trademarked by WinniRadio, LLC. All Rights Reserved.” The second stipulation would have been that you would have to send me the master to each of the programs from the very first show which was on 11/1/07. Thus, you have given me no choice but to sue you for infringement of my own copyrights and trademarks to my program.
However, since I am a nice person and willing to give you a chance, I am willing to forgo the lawsuit which in turn saves you from traveling to New Hampshire from your home in Oregon and all the court cost, lawyer fees and other incidentals, I would consider letting you do the show as long as you would agree in writing to the above two stipulations.
The ball is now in your court, Gerald. I hope to hear from you within the next few days as I will be talking to my legal staff early next week.
